Terms of Use

Last updated:

These terms are written to be readable, and they are a binding agreement. Questions? Email james@sozyr.tech.

1. Accepting these terms#

These Terms of Use are an agreement between you and Byte Market Holding Corp (“Byte Market”, “we”, “us”). By using our websites or apps, creating an account, or contacting us through our forms, you agree to these terms and to our Privacy Policy. If you don’t agree, please don’t use our services.

2. What these terms cover#

These terms apply to bytemarketholding.com, sozyr.com and centristcreative.com, and to our own apps: Bar Bump, Gozyr and Stargate Project, plus our earlier apps Centrist, CentriStack and GetFrendly while they remain available (together, the “services”).

Paid memberships and subscriptions are also covered by our Membership & Subscription Agreement. Some apps show extra rules inside the app; those rules are part of these terms for that app. Apps we build for clients (such as DuckSmart, PureRipper and DOGWORX) are governed by their owners’ terms, except where a client app links to these terms as its own, in which case they apply to that app until it publishes its own. Client development work through Sozyr is governed by the signed agreement for that project.

3. Who can use our services#

  • You must be at least 13 years old to use our services. If you are under 18, you need a parent or guardian’s permission.
  • Bar Bump is only for adults 21 and over, the legal drinking age in the United States.
  • You can’t use our services if you are barred from doing so under US law or the law where you live.

4. Your account#

Give accurate information when you sign up and keep it up to date. You are responsible for activity on your account and for keeping your password, device and sign-in methods (such as your Apple or Google account) secure. Tell us right away at james@sozyr.tech if you think someone else has accessed your account. One person per account; don’t share, sell or transfer it.

5. Acceptable use#

Use our services lawfully and respectfully. You agree not to:

  • harass, threaten, bully, stalk or impersonate anyone;
  • post content that is illegal, hateful, sexually explicit involving minors, violent, or that infringes someone else’s rights;
  • post someone’s private information or images without their consent;
  • spam, scam or defraud others, or abuse our contact forms;
  • use our AI features to create deceptive deepfakes of real people, or content that violates the AI providers’ usage policies;
  • hack, scrape, overload or interfere with our services, or try to get around security or access limits;
  • upload viruses or other harmful code, or reverse engineer our apps except where the law allows it;
  • use our services to promote drunk driving, underage drinking or other dangerous behaviour.

We may remove content or limit accounts that break these rules. You can report content or users through the app or by contacting us.

6. Your content#

You keep ownership of what you post, upload or create (“your content”). You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, display, adapt (for example, resize or compress) and distribute your content as needed to run, improve and promote the services. For content you make public, that includes showing it to other users. This license ends when you delete the content or your account, except for copies other users have already shared, copies in backups that are deleted over time, and where we must keep it by law.

You confirm you have the rights to your content and that it follows these terms. We don’t have to monitor content but may review, remove or refuse any of it.

7. AI features and accuracy#

Some features use artificial intelligence from providers such as OpenAI, Runway and ElevenLabs. AI output can be wrong, incomplete, outdated or unexpected, and it can resemble content created by others. Check anything important before you rely on it. You are responsible for how you use AI output, including making sure it doesn’t infringe anyone’s rights or mislead anyone.

As between you and us, you own the output you generate, to the extent the law and the AI provider’s terms allow. Similar output may be generated for other users. Information in our apps, such as Stargate Project’s datacenter map, comes from public and third-party sources and may not be complete or current.

8. Maps, location and outdoor safety#

Maps, distances, directions, venue details and location features are for convenience only. GPS can be inaccurate, and map data, opening hours and other details can be wrong or out of date. Pay attention to your surroundings, follow the law and posted rules, respect private property, and don’t use an app in a way that distracts you while driving or puts you or others at risk.

9. Nightlife and alcohol#

Bar Bump helps adults 21 and over find venues, people and events. Drink responsibly, never drink and drive, and plan safe transport home, such as a designated driver, rideshare, taxi or public transit. Meet people in public places and use your own judgment. Venues and events are run by third parties: we don’t control them, and we aren’t responsible for what happens there, for their prices or promotions, or for the conduct of other users.

10. No professional advice#

Content in our services, including AI output, is general information. It is not legal, financial, investment, medical, safety or other professional advice. Talk to a qualified professional before making decisions that affect your health, money, legal rights or safety.

11. No investment offering#

Nothing on our websites or apps is an offer to sell, or a request to buy, any security or investment, and nothing here is investment advice or a promise of returns. Descriptions of our portfolio, ownership or partnerships are simplified and for information only. Any investment, acquisition or equity arrangement happens only through separate signed legal documents.

12. Purchases and subscriptions#

Memberships and subscriptions in our apps are covered by our Membership & Subscription Agreement, which explains plans, free trials, auto-renewal, cancellation and refunds. Purchases from online stores linked from our apps are governed by that store’s terms.

13. Intellectual property#

Our services, including our software, designs, text, graphics, logos and the names Byte Market, Sozyr, Centrist Creative, Bar Bump, Gozyr and Stargate Project, belong to us or our licensors. We give you a personal, non-transferable, revocable license to use the services as these terms allow. Don’t copy, modify, sell or reuse our materials or branding without written permission. If you send us feedback or ideas, we may use them without owing you anything.

If you believe content in our services infringes your copyright, email james@sozyr.tech with the details, and we will review it and remove infringing content.

14. Third-party services#

Our services rely on and link to services we don’t control, including Apple, Google, Firebase, RevenueCat, AdMob, OpenAI, Runway, ElevenLabs, map providers, online stores and venues. Their terms and privacy policies apply to your use of them, and we aren’t responsible for their content, availability, decisions or errors. Apple and Google are not parties to these terms and aren’t responsible for our apps.

15. Changes and availability#

Our apps change. We may add, change, pause or remove features, or discontinue an app or website, at any time. We will try to give reasonable notice of significant changes. We don’t promise the services will always be available, error-free or compatible with your device. What happens to paid memberships when an app is discontinued is explained in the Membership & Subscription Agreement.

16. Suspension and termination#

You can stop using our services and delete your account at any time. We may suspend or close your account, or remove access to a service, if you break these terms, if your use creates risk or legal exposure for us or others, or if we discontinue the service. Sections that by their nature should survive (such as content licenses for feedback, disclaimers, limits of liability, indemnity and governing law) survive termination.

17. Disclaimer of warranties#

To the fullest extent the law allows, the services are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement and uninterrupted or error-free operation.

Some places don’t allow certain warranty disclaimers, so some of this may not apply to you.

18. Limitation of liability#

To the fullest extent the law allows, Byte Market and its owners, officers, employees, contractors and partners will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or goodwill, arising from or related to the services, even if we were told such damages were possible.

Our total liability for all claims related to the services is limited to the greater of (a) the amount you paid us for the service involved in the 12 months before the claim arose, or (b) US $100.

These limits don’t apply where the law doesn’t allow them, such as for liability that can’t be excluded for gross negligence, fraud or personal injury in some places.

19. Indemnity#

To the extent the law allows, you agree to defend and compensate Byte Market and its owners, officers, employees, contractors and partners for claims, losses and costs (including reasonable legal fees) that come from your content, your misuse of the services, or your breaking these terms or the law.

20. Governing law and venue#

These terms are governed by the laws of the State of Washington and applicable US federal law, without regard to conflict-of-law rules. Any dispute that isn’t resolved informally will be brought only in the state or federal courts located in King County, Washington, and you and we consent to those courts’ jurisdiction. This doesn’t take away any consumer protection rights you have under the law where you live. Before filing a claim, please email us so we can try to resolve it informally within 30 days.

21. Class action waiver#

Where the law allows, you and we each agree to bring claims only on an individual basis, not as a plaintiff or class member in any class, consolidated or representative action. If this waiver is found unenforceable for a claim, that claim will proceed in court under section 20.

22. General terms#

  • Changes to these terms. We may update these terms and will change the “Last updated” date. If a change is significant, we will tell you in the app or by email before it takes effect. Continuing to use the services after that means you accept the new terms.
  • Whole agreement. These terms, the Privacy Policy and the Membership & Subscription Agreement are the whole agreement between you and us about the services. A signed written agreement with us controls for the matters it covers.
  • Severability. If part of these terms can’t be enforced, the rest still applies.
  • No waiver. If we don’t enforce a term right away, we can still enforce it later.
  • Assignment. You can’t transfer these terms. We may transfer them, for example if an app is sold.
